U.S. Federal Court Issues Stay of Public Charge Ruling


In a dizzying development in the ongoing public charge court battle, the U.S. Court of Appeals for the Seventh Circuit has issued an administrative stay, or temporary pause, on the ruling from the District Court discussed in our post from November 3,2020. Accordingly, the new public charge rule will remain in effect for the time being, pending adjudication of the appeal filed by the government with the Seventh Circuit. This very likely means that the USCIS will continue to require the Form I-944 with most I-485 adjustment of status filings and will continue to adjudicate cases under the 2020 public charge guidance. Additional updates are expected in the coming weeks and will be posted here as they arise.
